Terms of Service

1. Service Description

HotspotWiFi ("the Service") is a cloud-based WiFi hotspot management platform that provides captive portal management, voucher billing, guest analytics, network security monitoring, and related services. The Service is operated by NexApps Technologies ("the Company"). By accessing or using the Service, you agree to be bound by these Terms of Service.

2. User Obligations

• You must be at least 18 years of age to use this Service.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.
• You shall not attempt to gain unauthorized access to the Service, other accounts, or computer systems.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete registration information.

3. Data Collection

The Service collects data necessary for its operation, including but not limited to: user account information, gateway configuration data, guest user session data (MAC addresses, IP addresses, session duration), voucher usage records, and analytics data. Data is collected and processed in accordance with our Privacy Policy. You are responsible for ensuring that your use of the Service, including collection of end-user data through captive portals, complies with applicable data protection laws.

4. Subscription and Payments

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis. You agree to pay all fees associated with your selected plan. Failure to pay may result in suspension or termination of your account. Refunds are handled on a case-by-case basis at the Company's discretion.

5. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. The Company's total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

6. Termination

Either party may terminate this agreement at any time. The Company reserves the right to suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service will cease immediately. Data retention after termination is governed by our Privacy Policy and applicable law.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

8. Changes to Terms

The Company reserves the right to modify these Terms at any time. Material changes will be communicated via email or through the Service dashboard. Continued use of the Service after changes constitutes acceptance of the revised Terms.
